Terms of Service

1. Acceptance of Terms

By accessing or using MotivatedSeller ("Service"), operated at motivatedseller.io, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MotivatedSeller provides automated motivation scoring of publicly listed real estate properties. Scores are generated from publicly available Zillow listing data using 8 proprietary signals. The Service is designed for real estate investors conducting market research in St. Petersburg, FL.

3. Account Registration

You must sign in using Google OAuth to access the Service. You are responsible for maintaining the security of your Google account. You must provide accurate information and promptly update any changes. You may not create multiple accounts or share your account credentials.

4. Subscription & Billing

• The Service offers Free, Starter ($19/month), and Pro ($99/month) tiers, with optional annual billing at a 20% discount.
• Paid subscriptions are processed through Stripe. By subscribing, you authorize recurring charges to your payment method.
• Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
• You may cancel at any time through the Account page. Access continues until the end of the current billing period. No prorated refunds are provided for partial billing periods.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect.

5. Permitted Use

You may use the Service for personal real estate investing research. You may not:

• Resell, redistribute, or sublicense data from the Service
• Use automated tools to scrape, copy, or extract data in bulk
• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Attempt to reverse-engineer the scoring algorithm
• Use contact information obtained through the Service for unsolicited mass communications in violation of TCPA or CAN-SPAM

6. Data Accuracy Disclaimer

The Service is for informational purposes only. Motivation scores, property data, and all information provided are estimates based on publicly available data and are not guaranteed to be accurate, complete, or current. The Service does not constitute financial, investment, legal, or real estate advice. You should independently verify all information before making any investment decisions. We are not responsible for errors or omissions in the data.

7. Intellectual Property

The Service, including its scoring algorithms, design, software, and content, is owned by MotivatedSeller and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

8. Limitation of Liability

To the maximum extent permitted by law, MotivatedSeller shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, and 10 survive termination.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Pinellas County, Florida.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or a notice on the Service.
